Domestic Violence

Domestic Violence is a social evil that occurs too often in many homes. If you are living in the same household with someone that abuses you (whether actual, threatened or harassing) we can assist and empower you in obtaining a tool for your protection. We have on numerous occasions succeeded in obtaining protection orders on behalf of our clients leaving them feeling safer and legally protected.

The Domestic Violence Act 116 of 1998 was implemented to protect the vulnerable individuals that are subject to domestic violence.

‘Violence’ can be in any of the following forms, physical abuse, harassment, staking, economic abuse, emotional, sexual, intimidation, damaging of property, threats etc.

If you are in a domestic situation where someone is threatening, harming or endangering your life, body, freedom or mental well being you don’t have to remain a victim at the hands of the abuser. The courts are here to protect you from this and our offices have great experience in using our expertise to obtain a protection order on your behalf. This serves as a weapon for you to use at any stage whereby you feel threatened. Should the abuser violate the court protection order, a warrant of arrest for the abuser may be issued and the abuser may face criminal charges and may be sentenced to imprisonment for up to 5 years.

More often than not, individuals are afraid to seek the courts protection and this in effect could lead to disastrous consequences. Don’t be a victim to abuse and let our offices assist you. For detailed up to date legal advise on your specific situation and to set up an appointment, contact us.

- Samantha (married for 12 years, 2 minor children), Samantha was in a volatile relationship and was constantly abused verbally & emotionally by her husband. The turning point for her was when she was so severely assaulted that it landed her in hospital. Samantha realized that if she had to stay in this marriage the next incident could have lead to her possible death. She lived in perpetual fear of her husband and could not live like this any longer. When she took the biggest step by leaving her marital home with her children, he constantly made threatening calls to her, and constantly stalked her. He attempted to run her over with his car but failed. - We realized the severity of Samantha’s situation and we assisted her by obtaining a protection order for herself and her children. She felt totally at ease knowing that she had a tool for her protection. When her husband disregarded the protection order he was arrested and is facing criminal charges.
